Who may be liable

The upstairs neighbor is not the only party who may be liable. It depends on the cause and the area of responsibility.

a neighbor — if the source is inside their apartment;
the management company, homeowners' association or housing construction cooperative — if the cause relates to common property or inadequate building maintenance;
a contractor — if the flooding relates to repairs or other work;
the developer — if a construction defect is identified during the warranty period;
several parties — if the causes and responsibility are shared.

You can send photographs of damage, the management company's incident record, videos, correspondence with neighbors, the management company or insurer, a valuer's report or court documents.
